Nison’s Warranty Policy 1. Unless a different warranty is provided in the Instruction Manual accompanying the Products , a 15 (Fifteen) months warranty after shipping date from China port, for non-conformance to the specifications set forth in Nison 's product literature (provided always that Nison shall have the rights to make changes to the specifications and the design of the Products by giving [6] months' prior notice to Distributor, and Distributor hereby acknowledges and agrees that prior to the signing of this Agreement) due to defective material and workmanship caused by Nison shall apply with respect to the Products. Any warranty with respect to a Product shall apply only if the Product is properly used in accordance with procedures described in the documentation supplied by Nison. 2. Nison’s exclusive obligation with respect to any nonconforming Product shall be, at Nison's option, to repair or replace such Product so that it substantially conforms to its specifications published on the date of the order. The foregoing is the Distributor's sole and exclusive remedy for breach of warranty by Nison with respect to the product. 3. No warranty shall apply to any Product which has been modified, repaired or altered, except by Nison or by Distributor (if Distributor has been trained and authorized by Nison and provided that there is no fault on the part of Distributor) or which has not been maintained in accordance with any handling or operating instructions supplied by Nison, or which has been subjected to unusual physical or electrical stress, misuses, abuse, negligence or accidents , or from which Nison's original serial number tag or product identification markings have been altered or removed… No warranty shall apply to any component of any Product which by its nature is intended to fail before the expiration of the warranty period unless such component does not give reasonable service for a reasonable time, and Nison shall in its sole discretion determine whether such component (i) has been shipped, handled and stored in accordance with Nison’s instructions, and (ii) is not suitable for use until the expiration date stated on the package. 4. Except for the warranties expressly set forth herein or in any other product literature delivered to Distributor, Nison disclaims all other warranties relating to the Products, express or implied, and expressly excludes any implied Warranties of merchantability, fitness for a particular purpose, or non-infringement of third party rights. Nison’s liability to the Distributor under the warranty shall be limited to repair or replacement of the Product. In no event shall Nison be liable for the cost of procurement of substitute goods by the Distributor. 5. Nison shall not be liable for any loss or damage resulting from the use, operation or performance of the Products or related in any way to their acquisition, regardless of the form of action, except for loss or damage caused solely by the gross negligence of Nison. In no event, including termination of this Agreement by Nison or Distributor, shall Nison be liable to Distributor for any special, indirect, incidental or consequential damages or any damages resulting from loss of use, interruption of business or lost profits, even if Nison has been advised of the possibility of such damages. Notwithstanding the foregoing, in no event shall Nison's liability to Distributor exceed the value of products purchased under this Agreement. 6. Distributor agrees to inform all its customers in writing, in accordance with all requirements relating to warranty disclaimers and liability limitations set forth in the applicable law of Hong Kong, of the warranty and liability limitations set forth in this policy. Distributor agrees to indemnify N for, and to defend and hold it harmless against, any claim, damages, loss, liability, or expense, including attorney's fees, arising out of or resulting from Distributor 's failure to comply with the requirements of this Section. Nison’s Return Policy
No Products can be returned unless such Products are defective. Such defective Products may only be returned within 3 months from the shipping date from China port of the relevant Products. No refund shall be made in respect of any such returned Products. Nison will only replace such returned Products subject to the terms of this Agreement. In relation to any Product to be returned to Nison for service, the following procedures should be followed: Obtain return authorization: The Distributor shall contact and provide details of model number, serial number, and a brief description of the reason for return to International Customer Support Department of Nison and obtain a Return Goods Authorization (RGA Number. The RGA number must appear on the outside of the shipping container. Return shipments will not be accepted if the RGA number is not clearly visible Freight policy: The equipment should be returned to the following address after obtaining RGA: |
